Welcome to BugBunny.ai. By accessing or using our products, websites, or services (collectively, the “Services”), you agree to these Terms of Service.

Company

The Services are provided by Sequester AG, Baarerstrasse 10, 6300 Zug, Switzerland.

1. Acceptable Use

You must only use BugBunny.ai for security testing of systems you own or are explicitly authorized to test. You are responsible for ensuring your activities comply with applicable laws and third‑party terms. We may suspend or terminate access for abuse or suspected unlawful activity.

• No testing without proper authorization.
• No attempts to bypass technical or organizational controls.
• No harmful or destructive actions beyond what is strictly required to validate a PoC.
• No prompt extraction: you must not attempt to extract, reconstruct, disclose, or publish any system prompts, hidden policies, or other proprietary instructions used by our LLM agents (including orchestrator, sandbox, and validator prompts), whether via prompt injection or any other means.

2. Accounts & Access

You are responsible for the security of your account and for all activity under it. Do not share credentials or tokens. We may change, suspend, or discontinue parts of the Services at any time.

3. Reports & Output

Findings and outputs are generated by AI agents and automated tooling. We aim for high quality and include validator steps, but results are provided “as is” and may require human review. You are responsible for how you use reports, and for responsible disclosure to vendors.

4. Intellectual Property

We retain all intellectual property rights in and to the Services, including (without limitation) the software, models, prompts, agent outputs, and any materials the Services produce (e.g., reports, PoCs, summaries, artifacts). You retain rights to the data you upload or provide to us. We grant you a non‑exclusive, non‑transferable license to use the outputs produced for you for your internal security purposes (including responsible disclosure). You agree not to remove proprietary notices, and not to misrepresent AI‑generated content as your original authorship.

5. Protection of System Prompts & Liquidated Damages

System prompts, hidden policies, agent instructions, and other internal configurations constitute confidential and proprietary information of Sequester AG. Any attempt to extract, reconstruct, disclose, or publish such information is strictly prohibited. In addition to any other remedies (including injunctive relief), you agree that a liquidated damages amount of CHF 250,000 (two hundred fifty thousand Swiss francs)will be immediately due and payable to Sequester AG for each breach or attempted breach of this obligation, as a reasonable pre‑estimate of harm (and not a penalty).

6. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee accuracy, non‑infringement, or fitness for a particular purpose. Security testing can have side‑effects; you accept the risks of using automated tools.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUGBUNNY.AI AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

8. Termination

You may stop using the Services at any time. We may suspend or terminate access for any breach of these Terms. Certain sections survive termination, including Disclaimers and Limitation of Liability.

9. Changes

We may update these Terms from time to time. Continued use constitutes acceptance of the revised Terms.

10. Governing Law & Venue

These Terms and any non‑contractual matters arising out of or in connection with them are governed by the laws of Switzerland, without regard to conflict‑of‑law principles. The legal seat (forum) for any court applications ancillary to arbitration is Zug, Switzerland.

11. Dispute Resolution (Arbitration)

Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, shall be resolved by final and binding arbitrationin Zug, Switzerland. The tribunal shall consist of one arbitrator. The language of the arbitration shall be English, unless otherwise agreed. The seat of arbitration shall be Zug, Switzerland. The parties waive any right to institute or maintain legal proceedings in ordinary courts except for interim measures or to enforce an arbitral award.
